Een sprookje over Fair Use

Professor Eric Faden van Bucknell University heeft een grappig filmpje gemaakt waarin uitgelegd wordt wat Fair Use is en waarom Disney een van de grote slechterikken is als het gaat om copyrightbescherming. Na het bekijken van het filmpje via de website van Stanford University wilde ik het graag downloaden zodat ik het kon converteren, eventueel ondertitelen etc. Maar helaas het filmpje was niet voorzien van informatie over de gebruiksmogelijkheden én het was alleen beschikbaar als streaming Quicktime. Het is even afwachten of mijn reactie door de moderatiecheck komt (“The comment you posted has been flagged as potential spam. It will not be visible until the site administrator has a chance to review it.”), dus daarom plaats ik hem hier in ieder geval al even online:

“Great movie. Too bad it is only available in streaming MP4. So I hoped to be able to make it available to others in other formats (like FLV). First thing I did was check the movie for any information about the license. I live in a country where Fair Use is not part of the copyright law, so that wasn’t an exception I can count on myself. The movie doesn’t state anything about what I can do with it. You want to lead by example, why not also show people that it helps tremendously if you provide clear information within a movie about what you think others can do with it?
The site cyberlaw.stanford.edu the movie is being displayed in states “Except where noted, content on this site is licensed under a Creative Commons Attribution 2.5 License” in the footer. Given the fact that there was no note in the movie stating a different license I expected it to be licensed under that license.
But why only provide it in streaming format only then? Why use the same tactics that other content providers use? Is it fear for Disney? Is it that you want to be able to take the move offline if a judge orders you to and because of that want to limit the number of places it is available?
All in all, many mixed signals.”

Door even te Googlen kwam ik er daarna overigens al snel achter dat het filmpje tóch al gewoon op Youtube te vinden is. Leuk, maar daar ging het me niet om, want hoe legaal is dat exemplaar daar nu dan?

[update] Omdat er nu inmiddels ook een downloadbare versie is én een heldere licentie, heb ik een vertaalde versie op dotSUB gezet.

We zijn nu een week verder en de reactie staat er niet, maar er is wél een downloadversie toegevoegd, een verwijzing naar de licentie én een link naar de Youtube-versie opgenomen. Maar dat zal vast niks met mijn reactie te maken hebben. ;-)

Hallo Pierre,
Prachtig zoals je dit hebt vertaald, het biedt nu met deze vertaling een uitstekend handvat om kinderen op een leuke manier duidelijk te maken hoe zaken met betrekking tot auteursrecht geregeld zijn. Wellicht is het handig om dit filmpje ook op wikikids te zetten? Dat kan tegenwoordig ook embedded via you tube, even uitzoeken of dat ook met jou vertaling zou kunnen. Ga eerst even overleggen!
